clarify The Owner’s obligations to The Renter, The Renter’s obligations to The Owner, and in the very unlikely event of any disputes, will be used as the basis for any resolution. Please read them carefully before confirming your booking. Check-In: From 16.00/ Check-Out: By 12.00 (High Season Weekly Rentals) For Low Season Weekend and Mid-Week Rentals an earlier Check-In and later Check-out may be possible upon request and shall be confirmed. Acceptance of these Terms & Conditions binds a contract between the following two parties: The Rental Applicant (The Renter) and The Property Owner (The Owner)

  • 1. Party Members 

  • All persons listed on the Rental Agreement or added subsequently by The Renter will be bound by the terms of this agreement. Occupancy of the property is restricted to those names listed on the Agreement or added subsequently by The Renter. The Rental Applicant is considered to be the Lead Renter and will assume full responsibility for all members of the Rental Group throughout the rental period Information or instructions relating to this rental will be communicated to the Rental Applicant only and not to any third-party member of the Rental Group.
  • 2. Payments

     A Reservation will be confirmed by Rhodes4vacation once the application has been approved and initial or full payment has been processed. For reservations of one week or more, if the reservation is made 45 days or more before the rental commences, an initial rental deposit payment of 30 % of the rental fee will be due at the time of booking and it is not refundable. If a reservation is made less than 45 days before the rental commences, or the reservation is less than a full week’s duration, the full rental fee must be paid at the time of booking. In the event of a reservation not being accepted by The Owner, all fees paid will be refunded immediately. Any booking made within 10 days of the start of the rental period must be paid in full by credit card via PayPal, or bank transfer at the time of booking. No reservation may commence without full payment being cleared. Once a reservation is received and accepted by The Owner, The Renter is liable for payment of the balance of the rental fee 45 days before occupation of the property. Non-payment by the due date will be treated as a cancellation and the deposit will be forfeited.
  • 3. Cancellation Policy & Changing a Booking 

  • Once a reservation has been accepted and confirmed, a cancellation can only be made in accordance with the terms below: – If the period of rental can be re-booked, a refund for the period re-rented or the part thereof, less a cancellation fee of 150 Euro will be issued. – If any part of the rental period cannot be re-booked, the Renter will forfeit all monies paid for that period.
  • 4. Occupancy of the Property 

  • Regardless of the published maximum number of persons a property can accommodate, the number of guests occupying the Property is strictly limited to those named on the Rental Agreement or any subsequent amendment notified in writing to The Owner. The stated and agreed occupancy figure includes all persons irrespective of age, day and overnight guests. Exceeding the number of stated and agreed persons will result in immediate eviction without refund, or a E 100 per guest per night charge at the discretion of The Owner.
  • 5. Condition of the Property 

  • The Property will have been inspected prior to occupation and therefore The Renter undertakes to: – Notify The Owner immediately with regard to any damage and/or maintenance issues that require attention. – Keep the Property and all furniture, fixtures, fittings, chattels and effects in or about the Property in the same state of repair and condition as found at the commencement of the Rental. – Where a cleaning service is provided; The Renter shall follow the departure instructions provided by The Owner. – Where a cleaning service is not provided; The Renter shall leave the Property in the same state of cleanliness and general order in which it was found. Failure to do so to the satisfaction of The Owner will result in a damage/cleaning charge being levied.
  • 6. Use of Telephone and Internet Services 
  • Where a telephone is provided as part of the rental, The Renter must charge all long-distance telephone calls to either a credit/phone card or call collect, unless advised otherwise. Where internet services are provided, there may be download restrictions and a charge may be levied if these are exceeded. It is The Renter’s responsibility to check for restrictions on an internet device before commencing any download.
  • 7. Pets
  •  One dog is permitted [please contact us prior booking]. All evidence of pet occupation must be removed from the Property and grounds at the end of the rental period. Pets are not permitted on any item of furniture, including beds, and evidence of pet hair on furniture and bedding may incur additional cleaning charges. OR Pets are strictly prohibited at this property. Any evidence of pet occupation will result in a forfeit of the damage deposit in its entirety. The Owner accepts no responsibility for any allergic reaction or other conditions arising from occupancy of the property. The designation of “No Pets” does not indicate there have not been pets at the property at some time.
  • 8. Smoking 
  • is sometimes not permitted in or around the immediate vicinity of the property,if not stated otherwise,most properties allow outdoor smoking.
  • 9. Property Access 
  • During Winter Months The Property is offered for rental during the winter months and has road access and . Consequently, ploughing at a property may be delayed for several hours or, in severe storm conditions, days. In the unlikely event that a Renter is unable to leave a property on the planned departure date, the Renter will not be liable for any additional accommodation charges.
  • 10. Equipment and Facilities 
  • Provided Equipment and facilities are provided at the discretion of The Owner and whilst every attempt is made to ensure that such equipment is in working order for the duration of the rental period, should a breakdown or some other situation occur that renders non-essential element unusable, the Owner does not take responsibility for replacing or refunding The Renter for the lack of use of these equipment or facilities. The equipment and facilities referred to include (but are not exclusive to) such items as watercraft, motors, televisions, VCRs/DVDs, hot tubs, saunas and Jacuzzi. The Renter must report any inoperative or defective equipment to The Owner promptly! The Owner will make every reasonable effort to have repairs made as soon as possible; however, there are limited service contractors in [Your Area]. While every attempt will be made to ensure that all the advertised equipment and appliances are in working order at the commencement of a rental period, no reduction of rent; rebate; or refund will be issued for a mechanical failure of air conditioning, dishwasher, washer, dryer, TV or other appliances.
  • 11. Refunds 

  • If a breakdown should occur to fundamental elements such as water systems, plumbing and electrical systems, and major appliances such as stove or refrigerator, every effort will be made to repair or replace, or an appropriate refund will be made for the inconvenience caused. This does not apply to system breakdown caused by misuse, such as plumbing blockages caused by inappropriate use of sanitary facilities.Please note that it’s not under any circumstance allowed to any throw paper in the toilets,every bathroom /WC got a bin. The Owner is not liable, nor will provide a refund, for any stoppage of electrical services caused by extreme weather or other circumstances beyond his control. Similarly, there will be no refunds for inclement weather, changes in water levels, conditions at neighbouring properties, or any nuisance afforded by the natural elements of the location such as flying insects or the animal population.Bugs!: Yea, we hate ’em, too. But roaches and ants are a reality in coastal area, especially during  Summer time. Some critters, like the  Cockroach can even fly inside from their nests outside. We do our best to keep the pests away – all of our properties are cleaned after every rental and receive  pest control treatments. As creepy as they may make you feel, an occasional roach or line of ants in this part of the world is a fact of life and does not mean the property has been poorly maintained.
  • 12. Other Conditions of Booking 
  • The Renter shall abide by these Terms and Conditions of Rental and any other instructions contained in the individual house Guide and any additional information and instructions as shall be supplied in the Property or by The Owner. LIMITATIONS OF LIABILITY: The Renter represents, warrants, acknowledges and agrees with The Owner that he/she will use the Property and its facilities in accordance with The Terms and Conditions above and the Information provided and that he/she does so at his/her own risk and that he/she indemnified and saves The Owner harmless from any personal injury, sickness or death, loss or damage, however caused, to person or property of The Renter, his/her family, or guests, before during or after the time of occupancy. Further, he/she accepts full responsibility for the use of the Property and any recreational equipment such as boats and motors, etc. and agree to pay for any damage of said equipment, other than for normal wear and tear. The Renter further acknowledges he/she is responsible for ensuring all Boating Regulations are observed, including having required safety equipment in the watercraft, as well as meeting current Operator Competency Requirements.
  • Unit Availability: 
  • While every effort is made to accommodate guests in the specific unit contracted, the owner of the unit may sell the property, make it unfit for rental or otherwise make it unavailable. Should this occur, Rhodes4vacation  shall make every effort to find suitable replacement accommodations for the same period without liability for breach of contract. However, rates at the replacement property may vary from the original property contracted.

  • – cancellation up to 56 days prior rental: not refundable deposit
  • – cancellation 55. bis 45. days: 50% of the rental
  • – cancellation 44. bis 33. days: 80% of the rental
  • – cancellation 32. Days : 100% of the rental

The cancellation has to be received in written 32 day’s prior arrival,any payments received will not be refunded. NO REFUND OF RENT FOR INCLEMENT WEATHER, CHECKING OUT EARLY OR ACTS OF GOD.We strongly recommend a Travel insurance for example ADAC (German Automobil Club) or AXA Insurance.

AGB Allgemeine Geschäftsbedingungen

  • § 1 – Bezahlung, Fristen, Rücktritt vom Vertrag: Anzahlung: 30% – in Höhe sofort nach Rechnungserhalt per Banküberweisung . Sämtliche Bankgebühren gehen zu Lasten des Auftraggebers (Mieters) ,im Falle einer Stornierung wird die Anzahlung beibehalten und nicht zurueckerstattet. Restzahlung: 70 % & Kaution & Nebenkosten bei Ankunft und Schlüsselübergabe Die Anzahlung beträgt 30% des Gesamtmietpreises und ist bei der Buchung fällig. Der unterschriebene Mietvertrag (Buchungsanfrage mit Bestätigung)) stellt die schriftliche Buchungsbestätigung dar und ist rechtsverbindlich. Die Anzahlung wird auf den Gesamt-Mietpreis angerechnet.
  • § 2 – Bezahlung bei einer kurzfristigen Anmietung: Bei einer Buchung bis zu 2 Wochen vor Beginn der Mietzeit ist der volle Mietpreis (exklusive der Kaution) sofort nach Erhalt des Mietvertrages zu überweisen (Valutastellung ist 3 Tage nach Erhalt des Mietvertrages). Sämtliche Bankgebühren/Paypal gehen zu Lasten des Auftraggebers (Mieters).
  • § 3 – Kaution: Es ist erforderlich, „mit der Restzahlung“ die Kaution bei Ankunft auf Rhodos zu zahlen.Bei der ordnungsgemäßen Abnahme des Hauses, wird diese Kaution, sofern keine Schäden und/oder Mängel im Haus festgestellt wurden,am Tag der Abreise zurück erstattet. Bei Zuwiderhandlungen der Mietbedingungen erfolgt eine Aufrechnung der Kaution.
  • § 4 – Rücktritt vom Vertrag seitens des Mieters: Sollte der Mieter von seiner Buchung zurücktreten müssen, so ist ein Rücktritt vom Vertrag nur schriftlich möglich. Der Vermieter wird sich auf Wunsch des Mieters nur im schriftlichen Auftrag um einen adäquaten Nachmieter bemühen. Sollte der Mieter selbst einen adäquaten Nachmieter stellen, so ist eine Umschreibung der Buchung und die Ausstellung eines neuen Mietvertrages erforderlich, die nur vom Vermieter vorgenommen werden kann. In beiden positiven Fällen wird dann die Höhe der vertraglich geschuldeten Rücktrittskosten ( Tabelle siehe unten ) auf 150 EUR Bearbeitungsgebühr zuzüglich der eventuell anfallenden Inseratskosten begrenzt. Wird für den stornierten Zeitraum kein adäquater Nachmieter gefunden, so ist der Mietpreis durch den Mieter, bzw.eine Rückerstattung durch den Vermieter bei bereits geleisteter Restzahlung wie folgt zu leisten Ersatzanspruch des Vermieters bei einem Rücktritt –
  • – Stornierung bis 56  Tage vor Mietbeginn: die Anzahlung wird nicht zurück erstattet
  • – Stornierung ab 55. bis 45. Tag vor Mietbeginn: 50% des Mietpreises
  • – Stornierung ab 44. bis 33. Tag vor Mietbeginn: 80% des Mietpreises
  • – Stornierung ab 32. Tag vor Mietbeginn: 100% des Mietpreises
  • Ein Rücktritt vom Mietvertrag gilt nur mit schriftlicher Erklärung! Maßgeblich ist der Eingang der schriftlichen Rücktrittserklärung bei dem Vermieter.
  • § 5 – Versicherung: Im Mietpreis ist keine Reiserücktrittskostenversicherung enthalten. Wir empfehlen dem Mieter den Abschluss einer Reiserücktrittsversicherung. Bei Beeinträchtigung des Urlaubs oder des Mietobjekts durch höhere Gewalt (Krieg, innere Unruhen, fehlende Treibstoffversorgung, Epidemien, Sturmfluten, Ölpest, Feuer, terroristische Gewalthandlungen o. ä.) haftet der Vermieter nicht. In solchen Fällen gehen entstehende Mehrkosten zu Lasten des Mieters. Wird der Vermieter durch höhere Gewalt an der Vermittlungstätigkeit gehindert, so kann er entschädigungslos kündigen. Verhindern andere Gründe, die ebenfalls nicht vom Vermieter zu vertreten sind, die Vermietung, so wird dem Mieter das Angebot unterbreitet die Reservierung rückgängig zu machen. In diesem Fall erhält der Mieter den geleisteten Mietpreis zurück und verzichtet auf weitere Ansprüche. (z.B. ADAC )
  • § 6 – Haftung: Der Mieter haftet für die Schäden, die er und/oder die ihn begleitenden Personen bzw. Besucher im oder am Haus des Vermieters verursachen. Der Vermieter haftet nicht für Vorkommnisse, für die der Mieter selbst zuständig ist und/oder für die den Mieter begleitenden Personen verantwortlich sind.
  • § 7 – An- und Abreise: Die Abreise muss aus organisatorischen Gründen bis ca. 11:00 Uhr erfolgt sein Die Anreise ist aus organisatorischen Gründen nicht vor ca. 16:00 Uhr möglich. Ausnahmen nur nach vorheriger Absprache und schriftlicher Bestätigung möglich. Schlüsselübergabe erfolgt vor Ort oder mit Hinterlegung in einem Schlüsselsafe (lock box ).
  • § 8 – Personenzahl, Haustiere: Das Mietobjekt darf nur mit der im Mietvertrag angegebenen Personenzahl belegt werden. Der Vermieter ist berechtigt, alle nicht im Mietvertrag aufgeführten Personen oder Haustiere unverzüglich durch sein Personal vor Ort abzuweisen. Weitere notwendige Regressansprüche, die sich aus einem regelwidrigen Verhalten des Mieters ergeben, bleiben dem Vermieter vorbehalten! Das Mitbringen von Haustieren muss unbedingt vorher vereinbart werden! Es wird eine zusätzliche Kaution von 150,- Euro für eventuelle Reinigung des Gartens sowie des Hauses verlangt.Nach der Rückkehr des Mieters und der ordnungsgemäßen Abnahme des Hauses, wird diese Kaution, sofern keine Verschmutzung im Haus und Garten festgestellt wurden, umgehend zurück bezahlt.
  • § 9 – Sachschäden, Gewährleistung, Mängelanzeigen: Der Mieter ist verpflichtet, das Haus und die gesamte Einrichtung sehr sorgfältig zu behandeln, bzw. seine Gäste und/oder Mitbewohner darauf aufmerksam zu machen Zuwiderhandlungen gegen diese Mietbedingungen haben u.a. den Verlust der Kaution, sowie – je nach Verstoß – die sofortige Räumung des Mietobjektes zur Folge.Aufgrund der besonderen Gegebenheiten in Griechenland weisen wir Sie darauf hin, dass keine Gegenstände (dazu gehört auch Toilettenpapier) in die Toiletten geworfen werden dürfen, die eine Verstopfung der Abflussrohre zur Folge haben könnten. Weitere Regress-Ansprüche bleiben dem Vermieter vorbehalten. Während der Mietzeit entstandene Schäden und/oder Beanstandungen, die schon bei Antritt der Mietzeit festgestellt werden, sind unmittelbar zu melden. Wir werden dann  umgehend für Abhilfe sorgen. Schadenersatzansprüche ohne Mängelanzeige sind ausgeschlossen.Insekten-wir hassen diese auch – leider  können Kakerlaken sogar von aussen ins Haus fliegen,das hat nichts mit der Sauberkeit des Hauses zu tun und gehört in diesem Teil der Welt zum täglichen Leben leider dazu.
  • § 10 – Gerichtsstand: Für Streitigkeiten aus dem vorliegenden Vertrag gilt der Ort des Mietobjektes als Gerichtsstand. Maßgebend ist griechisches Recht mit Gerichtsstand Rhodos. Wichtig: Der vorliegende Vertrag tritt mit dem Erhalt der Anzahlung(innerhalb 7 Tagen,3 Tage davon braucht die Überweisung nach Griechenland) in Kraft. Sollte dies nicht der Fall sein, so hat der Vermieter das Recht, das Mietobjekt ohne weitere Ankündigung und ohne gegenüber dem Mieter ersatzpflichtig zu werden, anderweitig zu vermieten. Wir empfehlen Ihnen auf jeden Fall eine Reiseruecktrittsversicherung ( z.B. ADAC ) abzuschliessen.
  • § 11 – Unterbringung:Im Falle einer Ueberbuchung oder wenn der Hausbesitzer das Objekt verkauft hat behält sich Rhodes4vacation vor die Gäste in ein anderes, vergleichbares Objekt in gleicher Lage unterzubringen.Rhodes4vacation ist nicht der Eigentümer des Ferienhauses, sondern ist nur Vermittler zwischen Mieter und Eigentümer. Rhodes4vacation vermittelt die auf der Internetseite beschriebenen Ferienhäuser und sämtliche Auskünfte auf der Internetseite sind nach bestem Wissen und Gewissen gegeben.
